This website is operated by Black Diamond Unlimited, LLC ("Black Diamond Unlimited," "we," "us," "our"), 3623 US Highway 62, Ropesville, TX 79358. By visiting our site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Shipping Policy, and Return & Refund Policy, which are part of these Terms. Our store is hosted on Shopify.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. You agree to give us accurate, complete information for all purchases.

2. Products, Fitment and Descriptions

We try to display products, prices, specifications and fitment as accurately as possible. Most product information comes from the manufacturers, and errors can occur. Fitment information is a guide. You are responsible for confirming that a part fits and suits your vehicle before purchase and installation. We are glad to help confirm fitment before you order. Product images may be representative.

3. Pricing and Availability

Prices are in U.S. dollars and may change without notice. Some products are sold at the manufacturer's minimum advertised price. Inventory is often held by manufacturers and distributors, so stock status can change. If an item becomes unavailable or was mispriced, we may cancel the order, or the affected item, and fully refund you. We reserve the right to limit quantities or refuse any order.

4. Orders and Payment

An order is an offer to buy. It is accepted when the item ships, or when we confirm a special or made-to-order item with the manufacturer. Payment is processed at checkout through Shopify's payment processors. Applicable Texas and other sales taxes are added at checkout.

5. Special-order and Made-to-order Items

Some items, including Bodyguard bumpers, No Limit Fabrication parts and Titan Turbos units, are special-ordered or built to order. Stated lead times are manufacturer estimates and are not guaranteed. These items cannot be cancelled once the order has been placed with the manufacturer, and return limits for special-order and custom items are described in our Return & Refund Policy.

6. Shipping, Risk of Loss and Returns

Shipping is governed by our Shipping Policy, and returns and refunds by our Return & Refund Policy. Risk of loss passes to you on delivery to the carrier. We will help you file claims for shipping damage or loss.

7. Emissions, Legal and Off-road Use

Some products are intended for off-road or competition use only. They may not be legal for use on public roads, or may not be sold for on-road use in certain states, including California and states adopting CARB rules. You are solely responsible for complying with all federal, state and local laws, including emissions and equipment laws, that apply to your purchase, installation and use. Products restricted in your state may not be shipped there. By purchasing an off-road-only product, you agree to use it only as lawfully permitted.

8. Installation and Safety

Many products should be installed by a qualified professional. Modifying a vehicle can affect handling, safety, emissions compliance and vehicle warranty coverage. We are not responsible for improper installation, misuse, or consequences of modifications.

9. Warranties

Products are covered only by the manufacturer's warranty, if any, which we will help you process. Except for those manufacturer warranties and as required by law, products are sold "as is." We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, Black Diamond Unlimited, LLC is not liable for any indirect, incidental, special or consequential damages, including labor, towing, rental vehicles, downtime, or lost profits, arising from the purchase or use of any product. Our total liability for any claim will not exceed the amount you paid for the product involved.

11. Indemnification

You agree to indemnify and hold harmless Black Diamond Unlimited, LLC and its owners and employees from claims arising from your breach of these Terms, your violation of any law, or your installation or use of products.

12. Site Content and Accounts

Site content, including text, photos and logos, belongs to us or to the manufacturers and may not be copied without permission. Brand names and trademarks belong to their respective owners. You are responsible for keeping your account credentials secure. Do not use the site for any unlawful purpose or attempt to interfere with its security or operation.

13. Third-party Links and Tools

Our site may link to third-party sites or tools, such as manufacturers and carriers. We are not responsible for their content or practices.

14. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state courts of Hockley County, Texas, or the United States District Court for the Northern District of Texas, Lubbock Division.

15. Changes

We may update these Terms at any time by posting changes on this page. Continued use of the site after changes means you accept them.
